Estita Fashion OÜ offers a unique platform for purchasing products, acting as a trusted intermediary between the buyer and the product supplier.
- We are not the manufacturer or owner of the products.
- All orders are processed through a dropshipping model, meaning that products are shipped directly from the supplier to the customer.
- Every product in our store is original. Estita Fashion OÜ holds all necessary certifications and permissions to sell the product, ensuring both quality and authenticity.
- In case of returns or exchanges, all inquiries are to be directed through Estita Fashion OÜ for coordination with the supplier.
- The customer agrees that goods are shipped from a third-party supplier and may be delivered from a different region.
1. General Provisions
1.1. These terms govern the legal relations arising between customers and Estita Fashion OÜ when purchasing goods.
1.2. The terms must not contradict the laws of the Republic of Estonia or the applicable laws of the European Union. They may be supplemented in accordance with the current regulations.
1.3. In addition to these terms, the relationship between the Customer and Estita Fashion OÜ is also governed by generally accepted norms, additional product information, and instructions, such as Delivery Policy, Return Policy, and Privacy Policy.
1.4. Estita Fashion OÜ reserves the right to make changes to the terms and product prices. If the Customer has placed an order before the changes come into effect, the terms applicable at the time of the order will apply, except as required by law or the terms themselves.
1.5. By submitting an order and making an advance payment, the Customer confirms that they have read and agree to the sales terms.
2. Prices of Goods
2.1. The prices of goods listed on the Estita.eu website are presented in euros, including VAT, and do not include shipping costs.
2.2. The shipping cost depends on the chosen delivery method and the Customer's location. All prices include VAT, which is calculated separately for each country.
2.3. Shipping prices:
Post (all countries, 4-8 working days):
0-5 kg: €6.90
Standard (3-5 working days): price depends on the location.
Express (2-3 working days): price depends on the location.
Free shipping: for orders exceeding €89.
Delivery is available only in the following EU countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden.
3. Order formation process
3.1. The customer’s shopping cart is created when they click the "Add to Cart" button.
3.2. Adding an item to the cart does not obligate the customer to make a purchase. The customer may adjust the quantity or remove items from the cart.
3.3. Items in the cart remain available to other customers until the order is confirmed.
3.4. To place an order, the customer agrees to the terms and clicks the "Buy" button.
3.5. The customer must provide a correct delivery address. If the address is incorrect and delivery is not possible, the item will be returned, and a fee of 15 € will be deducted.
3.6. The customer pays for the order using their chosen payment method.
3.7. The order is confirmed once the payment is received in the Estita Fashion OÜ account.
3.8. Estita Fashion OÜ forwards the order to the supplier with the necessary details (items, sizes, delivery address), charging a mediation fee.
3.9. The supplier processes the order, assembles the items, checks their quality, and prepares them for shipment in accordance with the delivery policy.
3.10. The order is handed over to DHL, where it is assigned a tracking number. This number is sent directly to the customer for tracking.
3.11. DHL delivers the order to the specified address or a pick-up point (e.g., Omniva or Itella).
3.12. The customer receives a notification about the delivery (via email or SMS).
4. Payment for Ordered Goods
4.1. Payment for the order can be made via bank links, Visa, MasterCard, Google Pay, or Apple Pay.
NB! When paying via bank link, it is necessary to click the "Back to Seller" button.
Payments are processed by Stripe. Payments are made in a secure environment: for bank payments - in the bank's secure environment, for credit card payments - in Stripe's secure environment. The seller does not have access to the customer's bank account or credit card information. The contract comes into effect after the amount is credited to the online store's account.
4.3. The owner of the online store is the responsible processor of personal data and transmits the necessary data to the authorized processor Stripe for payment processing.
4.4. The delivery fee is added to the total cost of the order upon placing the order.
4.5. The order confirmation includes information about the ordered goods and the customer's contact details for delivery.
5. Liability and Force Majeure
5.1. Estita Fashion OÜ is liable for damages to the Customer in accordance with Estonian law.
5.2. The Customer is liable for damages caused to estita.eu due to breach of the terms.
5.3. Neither party is liable to the other if the performance of obligations is hindered by force majeure circumstances.
5.4. Estita Fashion OÜ does not compensate for moral damages caused by changes in the delivery schedule, prices, or other conditions.
6. Processing of Personal Data
6.1. The online store uses the personal data entered by the buyer only for order processing and delivering goods to the buyer. The buyer's personal data will be transmitted for delivery only to its partners: product suppliers, payment service providers, and for order processing and delivery.
6.2. The online store will send newsletters and special offers to the buyer's email address only if the buyer has given consent by providing their email address on the website and indicating a desire to receive notifications.
6.3. The buyer has the right to unsubscribe from offers and newsletters at any time by notifying via email or following the cancellation instructions in the email offers.
7. Right to Submit a Complaint
Estita Fashion is responsible for the non-conformity of the goods sold to the customer with the terms of the agreement or for defects that existed at the time of transfer of the goods and became apparent within two years from the date of delivery to the customer. Within the first year from the date of transfer, it is assumed that the defect was present at the time of transfer. The burden of proof for the contrary rests with Estita Fashion.
If a defect appears no later than two months after delivery, the customer has the right to contact Estita Fashion by sending an email to return@estita.eu or by calling +372 54 810 810.
Estita Fashion is not responsible for defects that arose after the transfer of the goods as a result of the consumer's actions or inactions (incorrect use, accidents, etc.), nor for normal wear and tear resulting from the ordinary use of the goods.
If a product purchased from Estita Fashion has any defects for which the store is responsible, it will repair or replace the defective product. If the product cannot be repaired or replaced, Estita Fashion will refund the customer all payments related to the sales contract.
Estita Fashion will respond to the consumer's complaint in writing or in another form allowing written reproduction within 15 days.
8. Dispute resolution
7.1. If the customer has complaints about the online store, they should be sent to the email address contact@estita.eu, by phone at +372 5481 0810, or via the chatbot.
7.2. If the customer and the online store cannot resolve the dispute through negotiation, the customer may contact the Consumer Complaints Commission. The conditions for the procedure and the application submission are available on the designated website. The Consumer Complaints Commission reviews complaints free of charge and resolves disputes arising from contracts concluded between the buyer and the online store.
7.3. The customer may also contact the European Union Consumer Dispute Resolution Platform to submit a complaint and seek resolution.
